13. The winner(s) will be notified by email within three (3) days of the drawing.

14. The winner(s) must respond within three (3) days or an alternate entry will be drawn.

15. Prizes will only be shipped to the entrants registered address.

16. No substitution, assignment or transfer of prize(s) id permitted.

17. Winner is solely responsible for any and all applicable fees and taxes associated with prize receipt and use.

18. Winners of prizes or awards in excess of $600.00 will receive a tax form MISC-1099 to declare their winnings for tax purposes.

19. Except where prohibited, participation in any Contest, Giveaway or promotion constitutes winner's consent to Sponsor's use of winner's name for promotional purposes in any media without further payment or consideration.

20. The Sponsor reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest, as determined by Sponsor in its sole discretion.

21. In such event, the Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment.

22. The Sponsor reserves the right in its sole discretion to disqualify any individual found to be tampering with the entry process, the operation of the Contest or to be acting in violation of these Official Rules or in a disruptive manner.

22. Any attempt by any person to deliberately damage Sponsor's or any Promoter's Web site or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserve the right to seek damages from any such person to the fullest extent permitted by law.

22. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

23. All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Rococo Kidz or its content suppliers and protected by U.S., Canadian and international copyright laws. The compilation of all content on this site is the exclusive property of Rococo Kidz, with copyright authorship for this collection by Rococo Kidz, and protected by U.S., Canadian and international copyright laws.

24. Last but not least, entrant(s) agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Courts located closest to the Sponsor; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrantand the Sponsorin connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Sponsor's jurisdiction, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any other jurisdictions. All federal, state and local laws and regulations apply. Entrant agrees to receive at least one (1) email newsletter to the email address supplied by the entry process after which the entrant may opt-out, afterwhich the name and address stored in the newsletter database will be deleted.

APPLICABLE LAW

By visiting Rococo Kidz, you agree to laws of the juridiction of Rococo Kidz, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Rococo Kidz or its associates.

DISPUTES

Any dispute relating in any way to your visit to Rococo Kidz or contest, giveaways and promotions by Rococo Kidz shall be submitted to confidential arbitration. Except that, to the extent you have in any manner violated or threatened to violate Rococo Kidz intellectual property rights, Rococo Kidz may seek injunctive or other appropriate relief in any court in the jurisdiction of Rococo Kidz, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules a mutually acceptable arbitration or mediation group. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
